When family members’ capacity to make financial and medical decisions for themselves has become diminished, the hope is that they had already executed enduring powers of attorney and healthcare representation agreements, to allow someone they trust to make those decisions on their behalf. If those documents have not been prepared though, our lawyers can assist with contested or uncontested court applications for the appointment of a committee.

Other times, the incapacitated adults may be vulnerable to others who take advantage of them. This situation could arise when the person who they have granted a power of attorney to mismanages the adult’s financial affairs.

As well, we have assisted family members and advocated on their behalf in their fight to protect vulnerable adults from any kind of abuse. In some of those circumstances, we have worked closely with the Public Guardian and Trustee of British Columbia.
